1. Acceptance of Terms

By accessing and using MoveTogether, you accept and agree to be bound by these Terms of Use, along with our Privacy Policy. You also acknowledge that MoveTogether integrates with Strava's API and that you must comply with Strava's Terms of Service and API Agreement. If you do not agree to these terms, please do not use our service.

2. Service Description

MoveTogether is a platform that enables athletes to create and participate in fitness challenges using data from Strava. Our service allows you to:

  • Create public or private challenges with custom date ranges (up to 60 days) and scoring rules
  • Invite other Strava users via direct invitation or shareable invite links
  • Browse and request to join public challenges
  • Organize participants into teams for team-based competitions (up to 50 participants per challenge)
  • Sync your Strava activities to calculate scores and rankings
  • View individual and team leaderboards and track challenge progress
  • Communicate with other participants through challenge-specific chat messaging

3. Strava Integration & API Usage

3.1 Required Authorization: To use MoveTogether, you must have a valid Strava account and authorize our application to access specific Strava data through OAuth 2.0 authentication.

3.2 Data Access: By connecting your Strava account, you grant MoveTogether permission to:

  • Read your profile information (name, email, profile photo)
  • Access your activity data (activities, stats, routes)
  • View your performance metrics and achievements

3.3 Strava Compliance: MoveTogether operates in compliance with the Strava API Agreement. We do not:

  • Display your Strava data to other users without your explicit participation in shared challenges
  • Sell, rent, or transfer your Strava data to third parties
  • Use your data for advertising or AI/machine learning training
  • Store your activity data beyond 7 days in cache

3.4 Data Attribution: Activity data may include information from Garmin and other sources. When displaying such data, we provide appropriate attribution as required.

4. User Account & Responsibilities

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security and confidentiality of your account credentials
  • Be at least 18 years of age to use this service
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities conducted through your account
  • Not share your account with others or transfer it to another person
  • Comply with all applicable laws and regulations

5. Challenge Rules & Fair Play

5.1 Challenge Types: Challenges can be public (discoverable by all users) or private (invitation-only). Challenge owners have full control over:

  • Challenge visibility and scoring rules (modifiable at any time)
  • Approving or rejecting participation requests
  • Managing teams and assigning participants
  • Inviting specific users or sharing invite links

5.2 Challenge Limits:

  • Challenge duration is limited to a maximum of 60 days
  • Each challenge supports up to 50 participants
  • Start and end dates are locked once the challenge is created and cannot be modified

5.3 Fair Competition: You must not:

  • Manipulate or falsify activity data
  • Upload fraudulent activities to Strava
  • Use automated tools or bots to gain unfair advantages
  • Engage in any behavior that undermines fair competition

5.4 Data Visibility: When you join a challenge, other participants in that challenge can view your scores, rankings, challenge-related statistics, and messages you send in the challenge chat. Private challenges remain hidden from non-participants.

6. Prohibited Uses

You may not use MoveTogether to:

  • Violate any laws, regulations, or third-party rights
  • Transmit harmful, offensive, or inappropriate content
  • Harass, threaten, or abuse other users
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the service's operation
  • Use web scraping, data harvesting, or automated data collection
  • Reverse engineer or attempt to extract our source code
  • Create applications that compete with or replicate MoveTogether's functionality

7. Payments & Billing

7.1 Challenge Credits: To create challenges, you must purchase challenge credits. Each credit allows you to create one challenge. Credits are purchased at a price of €39.99 per credit and are processed securely through Stripe, our payment provider.

7.2 What You Get: Each challenge credit includes:

  • Ability to create 1 challenge per credit consumed
  • Up to 50 participants per challenge
  • Full team management features
  • Custom scoring rules
  • Challenge-specific chat messaging
  • Shareable invite links
  • Credits never expire and stack with future purchases

7.3 Payment Processing: All payments are processed by Stripe, Inc. When you make a payment, you agree to Stripe's Terms of Service and Privacy Policy. MoveTogether does not store your full credit card information. We only receive confirmation of successful payments from Stripe.

7.4 Pricing Changes: We reserve the right to modify the price per credit at any time. Changes will not affect credits already purchased.

7.5 Taxes: Prices are displayed in Euros (€) and may be subject to applicable taxes based on your location. Any required taxes will be added at checkout.

7.6 Billing Information: You agree to provide accurate and complete billing information. You are responsible for keeping your payment method up to date.

8. Refund Policy

8.1 No Refunds: All sales are final. Once you have purchased challenge credits, we do not offer refunds under normal circumstances. By completing your purchase, you acknowledge and accept this no-refund policy.

8.2 Service Issues Exception: The only exception to our no-refund policy is if there is a technical issue or service failure on our part that prevents you from using the challenge credits you paid for. This includes:

  • Extended service unavailability (more than 7 consecutive days)
  • Critical technical issues that prevent challenge creation or management
  • Platform errors that make challenge features completely unusable

8.3 Refund Requests for Service Issues: If you experience a qualifying service issue, you must:

  • Contact us immediately through our support channels
  • Provide detailed information about the issue you're experiencing
  • Allow us reasonable time to resolve the technical problem

We will work to resolve any service issues promptly. Refunds for service issues are granted at our sole discretion and only when the issue cannot be resolved in a reasonable timeframe.

8.4 Non-Qualifying Reasons: The following are NOT eligible for refunds:

  • Change of mind or buyer's remorse
  • Lack of use, failure to create challenges, or unused credits
  • Issues with your Strava account or connection
  • Dissatisfaction with features or functionality
  • Account termination due to Terms violation

8.5 Refund Processing: If a refund is approved due to a qualifying service issue, it will be processed within 5-10 business days to your original payment method through Stripe.

9. Data Retention & Deletion

7.1 Your Rights: You can request deletion of your data at any time by:

  • Revoking Strava authorization in your Strava settings
  • Leaving all challenges you've joined
  • Contacting us directly to request account deletion

7.2 Data Removal: When you revoke access or delete your account, we will remove your personal data within 48 hours, except where retention is required by law.

10. Intellectual Property

MoveTogether and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. Strava's marks, logos, and data remain the property of Strava, Inc.

11. Disclaimer of Warranties

MOVETOGETHER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The service will be uninterrupted, secure, or error-free
  • Results obtained will be accurate or reliable
  • Strava API integration will always be available
  • Any errors or defects will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVETOGETHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM:

  • Your use or inability to use the service
  • Unauthorized access to your data
  • Errors or interruptions in service
  • Disputes with other users
  • Issues with Strava API or third-party integrations

13. Account Termination

We reserve the right to suspend or terminate your access to MoveTogether immediately, without prior notice, if you:

  • Violate these Terms of Use
  • Engage in fraudulent or abusive behavior
  • Compromise the security or integrity of the service
  • Violate Strava's Terms of Service or API Agreement

Upon termination, your right to use the service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms of Use at any time. Changes become effective upon posting. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the updated terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
